Actibot - Messaging on WhatsApp and Instagram

These terms specifically cover the use of Actibot (WhatsApp chatbot) and of the Instagram features connected to Actib, and meet Meta's requirements. This is an English translation of the Spanish original, which is the reference text.

1. Scope
These Terms govern only the use of Actibot, the Actib.app WhatsApp messaging service, and of the Instagram features a Business connects to Actib (direct messages, comments and posts).
They do not govern other products, control panels or SaaS services offered by Actib, which are subject to separate terms.
2. Role of Actib
Actib provides technology infrastructure to facilitate communication between Businesses and their customers through WhatsApp and Instagram.
Actib:
- Does not control the content of messages
- Does not represent the Businesses
- Is not a party to the commercial relationship between the Business and the customer
3. Use of the Service
By interacting with a Business through Actibot or through its Instagram account connected to Actib, you agree to use the service lawfully and in line with the WhatsApp and Instagram policies and applicable law.
4. Types of Messages
Through Actibot, Businesses may send messages allowed by WhatsApp policies, including informational, transactional or promotional messages, as applicable. On Instagram, the Business can only reply within the 24-hour window Meta allows after the person's last message.
The frequency and nature of messages depend on the Business and on the WhatsApp and Instagram rules.
5. Availability and Liability
Actib does not guarantee uninterrupted delivery of messages and is not responsible for:
- Failures or interruptions of WhatsApp, Instagram or Meta
- Network or carrier delays
- Content, decisions or practices of the Businesses
6. Changes
Actib may update these Terms from time to time. The current versions will be available on the Actib website.
